Custom Design Service

Purpose


This document sets out the scope, process, fees, and terms for developing a custom design with the Client. It is written to be clear and concise so we can move efficiently from initial idea to an informed decision on whether to proceed.

All designs are created in Australia using ethically sourced materials, reflecting our commitment to quality and responsibility.

Stage 01: Concept & Cost Check (Complementary)


Client input

  • The Client provides an idea, space, or concept brief (any sketches, mood, constraints, budget guidance, timeline).

Fomu output

  • A brief feasibility concept – typically a simple 3D model and/or sketch with indicative dimensions and finishes sufficient for costing.

Notes

  • Stage 01 is a lightweight pass to establish feasibility and indicative cost.

  • It is complimentary and carries no licence to fabricate or publish.

Stage 02: Design Development


Design Fee
AUD $2,500 + GST (one-time), payable upfront to commence Stage 02. This fee is non-refundable.

What’s included

  • Iterative development of the design to align with the Client’s intent (dimensions, details, finishes) to a resolved fabrication package for Fomu-managed production.

  • Sourcing of materials/finishes and liaison with supplier(s) for practical constraints and lead times.

  • Updated drawings/3D as required to communicate the resolved design.

  • As experienced furniture designers, Fomu ensures that each piece is designed and tested for everyday use, with appropriate structural integrity to perform safely in both residential and commercial projects.

  • This stage is a collaborative process where Client feedback is integral. Together, we refine the design to ensure it reflects the Client’s intent while meeting the demands of everyday use.

Revisions

  • The Client may request unlimited changes during the first month of Stage 02, provided changes remain within the approved concept and intended function.

Cost impacts

  • Changes may affect manufacturing costs and may incur additional fees. Fomu will provide updated costings at each stage.

Stage 03: Production Management


What’s included

  • Fomu coordinates with trusted manufacturers to manage production, quality control, and delivery.

  • Every piece is developed with care, using trusted manufacturers and materials, and reviewed by Fomu to uphold standards of quality, longevity, and ethical sourcing.

  • Clients receive consolidated updates on timelines and progress.

Manufacturing payment

  • 100% of the quoted production price is required upfront before production begins. Production will not commence until funds have cleared (and, where applicable, samples are approved).

Lead times

  • Typical production lead times are dependent on supplier capacity. Usually around 8-12 weeks

Sampling & prototyping

  • Invoiced at supplier cost (no Fomu margin).

  • Paid samples/prototypes become the Client’s property once payment is made. Unpaid samples remain Fomu’s property. Sampling costs are non-refundable.

Costing & Pricing

  • Fomu will request indicative cost price from trusted manufacturer(s) based on the Stage 01 concept.

  • Fomu will present a consolidated cost breakdown for Client approval. Supplier identities and relationships are managed solely by Fomu.

Production units

  • First project: Invoiced at supplier manufacturing cost only; freight at cost.

  • Reuse or additional projects: If the same item is produced again, units will be quoted at cost + 19% per unit (ex GST); freight additional.

Additional Terms

Currency and taxes

  • All amounts are quoted in Australian Dollars (AUD) and exclusive of GST unless stated otherwise.

Payment terms

  • Payment must be made in full by the due date. Late payments may incur interest or administrative fees.

Non-circumvention (suppliers)

  • The Client agrees not to contact or procure directly from Fomu’s suppliers or manufacturers for this design at all, without Fomu’s written consent.

Material variation and tolerances

  • Natural materials and hand processes may vary. Reasonable differences in colour, grain, and dimensions (±2–3 mm typical unless noted) are not defects.

Compliance and certifications

  • If compliance such as seat strength, durability or load testing is required (for example, to meet AS/NZS standards for commercial seating), the Client must notify Fomu in writing. Certification and testing will be arranged by Fomu and invoiced at cost to client.

Freight

  • Fomu can arrange packaging and freight on behalf of the Client; all freight and packaging costs are invoiced to and payable by the Client.

  • Freight insurance is the Client’s responsibility unless otherwise agreed.

  • If delivery is delayed by the Client, storage or handling fees may apply at cost.

Warranty

  • Manufacturing defects will be repaired or replaced (at Fomu’s option) within 12 months of delivery.

  • All designs are created and tested for everyday use, with structural integrity to ensure they perform safely under normal residential and commercial conditions.

  • This excludes wear and tear, misuse, improper installation, or unauthorised repairs.

Client obligations

  • The Client must provide timely approvals, decisions, and payments to prevent delays.

Photography

  • The Client must arrange professional photography of the completed space or item and provide high-resolution images to Fomu.

Intellectual property

  • All concepts, drawings, designs, models, and other intellectual property remain the property of Fomu. The Client is granted a licence to use the design solely for the agreed project. Any reuse, reproduction, or adaptation without written consent from Fomu is prohibited.

Publicity

  • Fomu may document the design and production process, including work-in-progress imagery, prototypes, and behind-the-scenes content.

  • Fomu may publish this material on its website, social media channels, portfolio, and in press features unless the Client requests confidentiality in writing before production.

  • The Client must credit Fomu as the designer in all social media posts, online publications, and print where the design or photography is featured.

Termination and cancellation

  • If the Client cancels after Stage 02 has commenced, the design fee remains non-refundable, and any costs incurred (sampling, prototyping, materials) remain payable.

Force majeure

  • Fomu is not liable for delays caused by events beyond its reasonable control, including supplier delays, shipping disruptions, natural disasters, or government restrictions.

Dispute resolution and governing law

  • This agreement is governed by the laws of Tasmania, Australia.

  • Parties will first attempt good-faith negotiation, then mediation before further action.

Publicity

  • Fomu may photograph and publish the work (including work-in-progress imagery) for portfolio and press unless the Client requests confidentiality in writing before production. Clients may request to review press imagery before publication.

Quote validity

  • Supplier and manufacturer quotes are subject to their own validity periods and may change with design revisions or after expiry.
